1. General Rental Conditions

1.1 This contract is entered into between Florida First Class Villas LLC and the Renter. The property is rented for the duration specified in the booking confirmation.

1.2 The vacation home is available from 4:00 PM on the day of arrival. On the day of departure, the property must be vacated no later than 10:00 AM.

1.3 A deposit of 30% of the total rental price is due no later than three days after booking. Payment of the deposit, signing of the credit card form and execution of the rental agreement are required to secure the reservation.

1.4 The remaining balance must be paid prior to arrival and may be paid by credit card, PayPal or wire transfer.

2. Attorney Fees

2.1 Should it become necessary for the Owner or Florida First Class Villas LLC to employ an attorney to enforce the terms of this agreement, the Guest shall be responsible for all associated costs and reasonable attorney fees, including but not limited to in-house legal counsel, whether or not legal proceedings are initiated.

3. Bicycles, Kayaks and Jet Skis

3.1 Certain vacation homes provide bicycles, kayaks or jet skis for guest use at no additional charge. Guests are required to comply with all applicable traffic and safety regulations.

3.2 By using these items, Guests and their invitees fully release and discharge the Owner, Florida First Class Villas LLC and all affiliated parties from any claims, liabilities or damages arising from use, operation, maintenance or design of the equipment.

3.3 This release includes claims for personal injury, property damage, injury to third parties or wrongful death, whether caused by negligence or otherwise.

3.4 Guests acknowledge that no claim or legal action may be brought against the released parties in connection with such use.

4. Cancellations

4.1 All cancellations must be submitted in writing.

4.2 Cancellation fees are as follows.
4.2.1 More than 90 days prior to arrival: 30% of the total rental price
4.2.2 90 to 61 days prior to arrival: 50% of the total rental price
4.2.3 60 to 31 days prior to arrival: 80% of the total rental price
4.2.4 Less than 30 days prior to arrival: 100% of the total rental price

4.3 The remaining rental balance is due four weeks prior to arrival.

4.4 Cancellation costs may be reduced if the property is re-rented for a comparable period.

4.5 If the Owner or Florida First Class Villas LLC cancels the reservation, all payments received will be refunded within 14 days.

4.6 Trip cancellation insurance is strongly recommended.

5. Check-In and Check-Out

5.1 Check-in begins at 4:00 PM on the day of arrival. Guests must contact their designated agent one hour prior to arrival.

5.2 Ordered packages such as welcome, breakfast or BBQ packages will be available upon arrival.

5.3 Check-out must be completed before 10:00 AM on the day of departure.

5.4 The property must be left in proper condition. Any damages or malfunctioning equipment must be reported immediately.

5.5 Refunds or adjustments will not be made for late arrivals or early departures.

6. Cleaning Charges

6.1 Cleaning fees are specified in the booking confirmation and include applicable sales taxes.

6.2 For stays longer than four weeks, additional interim cleaning is recommended and available at an additional charge.

6.3 Additional cleaning charges may apply for excessive dirt, furniture stains, carpet stains, heavily soiled microwave or oven, or an unclean outdoor BBQ grill.

6.4 Guests are responsible for inspecting the BBQ grill at check-in and cleaning it prior to departure.

7. Fees

7.1 All bank fees, transfer fees or payment-related charges are the responsibility of the Guest.

7.2 Payment assistance may be requested via email at boss@floridafirstclassvillas.com.

8. Hazards

8.1 Florida First Class Villas LLC and the Owner do not guarantee the absence of hazardous substances.

8.2 Possible hazards may include mold, lead-based paint, asbestos, radon gas and chemical substances.

8.3 Properties built prior to 1978 may contain lead-based paint.

9. Indemnification

9.1 Guest agrees to indemnify and hold harmless the Owner and Florida First Class Villas LLC against all claims or damages arising from Guest actions or omissions.

9.2 This obligation survives the termination of the rental period.

10. Keys and Garage Door Openers

10.1 All keys and garage door openers must be returned upon departure.

10.2 Lost keys or garage door openers will be charged at $60 per item.

11. Maintenance

11.1 The Owner is responsible for maintenance unless damage is caused by Guest misuse or neglect.

11.2 No rent reduction will be granted unless the property is deemed uninhabitable.

11.3 Guests may not alter the property or furnishings and must return furniture to its original position if moved.

12. Occupancy

12.1 Only registered Guests may occupy the property.

12.2 Additional guests require prior approval and may incur additional fees.

12.3 Exceeding maximum occupancy may result in immediate termination of the agreement without refund.

13. Pets and Service Animals

13.1 Pets are permitted only in designated homes with prior approval and payment of the applicable pet fee.

13.2 Service animals are accepted in accordance with ADA regulations.

13.3 Guests remain fully liable for any damage caused by pets or service animals.

13.4 Misrepresentation of a pet as a service animal may result in eviction without refund.

14. Pool and Spa

14.1 Use of pool and spa facilities is entirely at the Guest’s own risk.

14.2 Guests must ensure all safety measures are followed, particularly with children and non-swimmers.

14.3 Any defects or issues must be reported immediately.

15. Private Areas and Storage

15.1 Areas designated as private or for storage are not accessible to Guests.

16. Property Care

16.1 All items within the home are the personal property of the Owner and must remain in the home.

17. Radon Gas

17.1 Radon gas may be present in Florida properties. No representations are made regarding radon levels.

18. Rent Reduction

18.1 Temporary malfunction of appliances or systems does not entitle the Guest to rent reduction if repairs are addressed within 24 hours.

19. Replacement Vacation Home

19.1 Guests are not entitled to a replacement home due to external circumstances such as construction noise, weather or neighborhood conditions.

19.2 Florida First Class Villas LLC may substitute comparable accommodation if the reserved property becomes unavailable.

20. Right of Entry

20.1 Florida First Class Villas LLC reserves the right to enter the property in case of emergency or with prior notice.

21. Risk of Loss

21.1 Guest personal property is kept at Guest’s own risk. The Owner is not liable for loss or damage.

22. Security Deposit

22.1 A security deposit may be required prior to check-in.

22.2 The deposit may be applied to damages, utilities or outstanding charges.

22.3 Any remaining balance will be refunded within 30 days after departure.

23. Smoking

23.1 Smoking is strictly prohibited inside the rental property.

24. Trash Disposal

24.1 Trash must be disposed of according to the provided instructions.

24.2 Failure to comply may result in additional charges.

25. Telephone

25.1 Local calls are free where a landline is available.

25.2 International or chargeable calls will be billed to the Guest.

26. Usage of Vacation Home

26.1 The property may only be used for residential purposes.

26.2 Commercial use or illegal activities are strictly prohibited.

27. Vehicles

27.1 Boats, motor homes, trailers, commercial vehicles or motorcycles are not permitted unless explicitly approved.

28. Wi-Fi and Internet Usage

28.1 Complimentary Wi-Fi is provided.

28.2 Accessing illegal or unauthorized websites is strictly prohibited and may result in immediate termination and legal reporting.

29. Legal Disclaimer and Jurisdiction

29.1 Florida First Class Villas LLC is not responsible for personal items left behind.

29.2 Jurisdiction is Lee County, Florida.

29.3 Florida law governs this agreement.

29.4 If any provision is deemed invalid, the remaining provisions remain enforceable.
